These Terms of Use ("Terms") govern your access to and use of the Pixel website, dashboard, APIs, and related services (together, the "Service") provided by Pixel Systems AB ("Pixel," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms.

1. Relationship to other agreements

If you have signed, or later sign, an individual service agreement, master agreement, order form, data processing agreement, or similar written contract with Pixel covering the Service, that agreement controls and these Terms apply only to the extent not contradicted by it.

2. The Service

The Service helps you assess whether digital content (such as images) is authentic or has been generated or manipulated by AI. Detection is probabilistic. Outputs are indicative and should not be treated as definitive proof or as forensic, legal, or expert evidence unless a separate written agreement with Pixel says otherwise. You are responsible for how you use, interpret, and act on the Service's outputs.

We may add, change, or discontinue features of the Service at any time.

3. Accounts and API keys

You must provide accurate registration information and keep it current. You are responsible for safeguarding your account credentials and API keys and for all activity under them. Notify us promptly if you suspect any unauthorized access or compromise. We may apply reasonable rate limits and usage controls.

4. Acceptable use

You agree not to:

  • Use the Service in violation of any law or third-party rights.
  • Use the Service to harass, defame, stalk, surveil, or unlawfully discriminate against any individual.
  • Use the Service's outputs as the sole basis for any legally or materially consequential decision about a person (such as employment, immigration, denial of services, or accusation of wrongdoing) without independent verification.
  • Misuse, interfere with, probe, or disrupt the Service or any related systems.
  • Reverse engineer, decompile, or attempt to extract source code, models, weights, or training data, except where applicable law expressly permits.
  • Scrape, mirror, or resell the Service without our written permission.
  • Submit content you have no lawful right to submit.

5. Your content

You retain all rights in content you submit to the Service ("Submitted Content"). By submitting it, you grant Pixel a worldwide, non-exclusive, royalty-free license to host, process, and analyze the Submitted Content to operate, secure, support, and improve the Service, including to evaluate, develop, and train Pixel's detection technology. We apply reasonable measures to de-identify Submitted Content used for model training and do not sell it or make it publicly available.

Customers with stricter requirements, including a commitment that Submitted Content will not be used to train or improve our models, may agree to additional terms in a separate written agreement, which will override this section.

You represent that you have all rights, permissions, and lawful bases necessary to submit the content and to grant the license above.

6. Our intellectual property

The Service, including all software, models, designs, and documentation, is and remains the property of Pixel and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. We retain ownership of aggregated and de-identified data and metrics generated from operation of the Service.

7. Privacy

Our processing of personal data is described in the Privacy Policy and, where applicable, in a separate data processing agreement between you and Pixel.

8. Fees

If the Service or any part of it is paid, the applicable fees, payment terms, and refund policy will be set out in the relevant order form or commercial agreement.

9. Confidentiality

Each party will protect the other's non-public information disclosed in connection with the Service with the same care it uses to protect its own confidential information, and at minimum with reasonable care.

10. Term and termination

These Terms apply for as long as you use the Service. We may suspend or terminate your access if you breach these Terms, if required by law, or if your account presents a security or abuse risk. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

11. Disclaimer

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Pixel disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any specific detection result will be correct.

12. Limitation of liability

To the maximum extent permitted by law, Pixel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to the Service. Pixel's total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the fees paid by you to Pixel for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred euros (EUR 100). Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to defend and indemnify Pixel against third-party claims arising from your breach of these Terms, your misuse of the Service, or your Submitted Content. More detailed indemnities may be set out in a separate written agreement.

14. Changes

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, for material changes, take reasonable steps to notify users. Continued use of the Service after changes take effect constitutes acceptance.

15. Governing law and venue

These Terms are governed by the laws of Sweden, without regard to conflict-of-laws principles. The Stockholm District Court (Stockholms tingsrätt) will be the court of first instance for any dispute, subject to any mandatory rights of consumers.
